The House Judiciary Committee is meeting TOMORROW to mark-up H.R. 2377, the Federal Extreme Risk Protection Order Act of 2021.
This "Red Flag" law, if enacted, would give the government the power to confiscate your guns for up to 180 days at a time without actually having to charge or convict you with a crime!
This is what Democrats have always wanted and now they are just one step away from making their gun confiscation dreams a reality!
A bill has to go through a couple of steps before it can reach the floor under what's called "regular order." But the most important step is the mark-up. This is where a relevant committee will discuss the bill and edit it before voting on whether to send it to the floor. That is what is happening tomorrow in the Judiciary Committee. If H.R. 237 passes in the Judiciary Committee tomorrow, then the Left will be able to race it to the floor for a full vote. There is no time to waste!
Our justice system is built on the concept that all men and women are innocent until proven guilty. The government has the obligation to prove beyond a reasonable doubt that a crime has been committed before a defendant can be convicted of a crime and lose his or her rights. That defendant also has the right to a jury trial, where their lawyers can seek to convince a jury of their peers that their client is not-guilty. Convincing just one juror can lead to a mistrial.
Well, Red Flag Laws - like the one Congress is advancing tomorrow - turn this concept on its head. Instead of people being presumed innocent, the laws presume that gun owners are guilty. Family members, estranged spouses, roommates, neighbors, co-workers, or law enforcement officers can petition the court to have someone's firearms taken away. The court then holds an "ex parte" hearing, without the defendant being notified or allowed to attend. The judge will then decide whether to issue a 14-day gun ban against the firearm owner. Remember, at this point, not a single criminal charge has been filed. The gun owner is still legally innocent.
The gun owner must then hire a lawyer and fight to have their rights restored. Except instead of the prosecutors needing to prove 'guilt beyond a reasonable doubt,' they can get the gun confiscation order extended if they can provide "clear and convincing evidence" that someone is dangerous. If the judge agrees, then they can extend the firearm confiscation order for 180 days. Again, this whole process happens without any charges being filed whatsoever.
This may not seem like a big shift, but it is. "Beyond a reasonable doubt" is the highest legal standard employed in our judicial system. It holds that even if there is a shred of reasonable doubt, a defendant must be found not-guilty.
The "Clear and Convincing Evidence" standard is one step lower. All that requires is that a single judge decide that something is more likely to be true than false. If a judge believes there is a 51% chance that someone is dangerous, that is enough to get their guns taken away for half a year... Sure, the gun owner would be able to go back in half a year to try to get their rights back, but if the judge still believes they are probably dangerous, the order could be extended again...
This is what the Democrats always wanted: The ability to confiscate Americans' guns without actually having to prove they have done anything wrong. This is an essential piece to the Left's gun confiscation plans and the idiots in the GOP are just going to give it to them!
Forget about "innocent until proven guilty." This bill would presume gun owners are "guilty until proven innocent." It would give the government the power to disarm innocent people without even needing to accuse them of breaking the law...
This is what the Left has always wanted. Forget about the right to keep and bear arms. H.R. 2377 is designed to turn that right into a privilege that can be revoked at any time...
Every tyrant in history has enacted gun confiscations. Just look at the tyranny taking hold in Australia right now. That never would have happened without years and years of gun confiscations. THAT is why the Left wants to pass this bill into law here! What is even more disgusting is that there are GOPers supporting this confiscation bill!
Look around... Things are getting really, really bad in this country. The 2nd Amendment exists to make sure that a free people will always occupy the North American continent. It exists to make sure that when the government becomes destructive to individual liberty, it can be abolished. Without the 2nd Amendment, we are all slaves. That is what the Left is pushing for here: The right to take away Americans' guns without even having to accuse them of breaking the law.
You CANNOT let them get away with this!
