To Members of Congress and the Incoming Trump Administration:

This year, we have watched our constitutional rights erode again and again. Yet with the election of Donald Trump, we have a renewed opportunity to change this course and restore the freedoms that are foundational to our nation. In April, the House and Senate disregarded the will of the American people, choosing to reauthorize the Foreign Intelligence Surveillance Act (FISA) for an additional two years. However, all hope is not lost. Donald Trump's administration, committed to restoring the Constitution, has a historic opportunity to put an end to FISA’s overreach and reinstate our nation's commitment to civil liberties.

In December 2023, FBI Director Christopher Wray appeared before the Senate Judiciary Committee to advocate for the intelligence community’s warrantless surveillance powers, urging Congress to grant further allowances to review Americans' private information without court-issued warrants. This is a direct assault on the Fourth Amendment, and it leaves Americans vulnerable to an unjust surveillance state. In the face of this, Congress voted to extend FISA until April 2024 and subsequently reauthorized it for two additional years. The American people are exhausted by being subjected to government surveillance and seeing their Fourth Amendment rights ignored. This must end.

Before the FISA extension in December 2023, Senator Mike Lee of Utah and other bipartisan lawmakers raised their voices in opposition. They signed a letter underscoring the urgent need for reform, with Senator Lee calling on Congress to protect the civil rights of American citizens. Despite these efforts, FISA was reauthorized in April, presenting the incoming Trump administration with an important opportunity to end FISA in 2026 or, hopefully, sooner.

Congress has failed to end FISA multiple times, leaving Americans to endure two more years of rights violations. However, the inauguration of the Trump administration presents a pivotal chance to be on the right side of history and take a stand for our freedoms. Congress has a duty to safeguard the liberties of the American people, and I call upon both Congress and the Trump administration to end FISA in its entirety.

The time has come to dismantle the surveillance state. End FISA. End warrantless surveillance. Protect the rights and privacy of the American people.
