Yesterday, the Eastern District of New York gave a joint press conference with the Department of Justice and the FBI regarding multiple efforts to “crack down” on Chinese influence and activities in the US. 

Three independent but connected efforts were revealed during the press conference, and three separate press releases were issued on the effort.

In the first release, “...a complaint was unsealed in federal court in Brooklyn charging 34 officers of the national police of the People’s Republic of China (PRC) – the Ministry of Public Security (MPS) – with harassing Chinese nationals residing in the New York metropolitan area and elsewhere in the United States. The defendants allegedly perpetrated transnational repression schemes targeting U.S. residents whose political views and actions are disfavored by the PRC government, such as advocating for democracy in the PRC. All the defendants are believed to reside in the PRC, and they remain at large.”

The second release reveals the arrest of two PRC actors, charging the two defendants, “...in connection with opening and operating an undeclared overseas police station, located in lower Manhattan, for the Ministry of Public Security (‘MPS’) of the People’s Republic of China (‘PRC’).”

“This prosecution reveals the Chinese government’s flagrant violation of our nation’s sovereignty by establishing a secret police station in the middle of New York City,” stated Breon Peace, United States Attorney for the Eastern District of New York.

This is a significant amount of effort and taxpayer resources expended on protecting the civil liberties of Chinese nationals, especially during a time when the same DOJ and FBI are institutionalizing the civil liberty violations of Americans. 

The third release reveals that a China-Based Executive at “a US Telecommunications Company,” referred to as Company-1 in the unsealed complaint, has been charged with disrupting video meetings commemorating Tiananmen Square Massacre. 

The identity of the US company has not been revealed; however the nature of the allegations point to one of the major US platform providers like Amazon, Microsoft, or Google. 

The feds allege the defendant coordinated with the PRC to target dissidents and disrupt meetings in an effort to violate the First Amendment:

“As alleged, Jin worked closely with the PRC government and members of PRC intelligence services to help the PRC government silence the political and religious speech of users of the platform of a U.S. technology company.  Jin willingly committed crimes, and sought to mislead others at the company, to help PRC authorities censor and punish U.S. users’ core political speech merely for exercising their rights to free expression,” stated Seth D. DuCharme, Acting United States Attorney for the Eastern District of New York.

DuCharme continued, “The charges announced today make clear that employees working in the PRC for U.S. technology companies make those companies—and their users—vulnerable to the malign influence of the PRC government. 

Assistant Attorney General Demers added, “No company with significant business interests in China is immune from the coercive power of the Chinese Communist Party.”

The American People deserve to know which US platform provider is doing the bidding of the Chinese Communist Party. Why is this information concealed from us? 

DEMAND FOR REMEDY: (1) Reveal the US companies collaborating with the Chinese Communist Party along with the specific evidence and actions they’ve taken. If you refuse, you’re engaging in manipulation to protect these companies from the market consequences of their actions. (2) Take action to ensure that the US Executive Branch and their DOJ begins protecting the rights of Americans with the same level of fervor and prioritization placed on Chinese nationals.
